Coldwell Banker Milestone: Agency Explained
Our job is to help both Sellers and Buyers accomplish their individual goals with the least amount of stress and the most fun possible!
As real estate professionals, we are licensed by the State to represent a person for the sale or purchase of real property. While we practice fairness and honesty in all aspects of the transaction, a Fiduciary relationship between Agent and Client is special because the agent owes the following duties to the client: loyalty, diligence, confidentially, obedience, disclosure, accounting, and reasonable care.
Through its agents and with signed acknowledgement of the parties involved, Coldwell Banker Milestone Real Estate offers the following agency representation:
Seller's Agency: As the listing office, CB Milestone will represent the Seller, although, with written consent, we can act as Disclosed Dual Agents (see below). Other agents, who show our listings and are not acting as Buyer's Agents, accept our offer of sub-agency and become sub-agents of the Seller.
Buyer's Agency: CB Milestone can represent the Buyer in his/her search for and purchase of property, although, with written consent, we can act as Disclosed Dual Agents (see below). A separate contract is required between CB Milestone and the Buyer to establish a Buyer's Agency relationship.
No Agency: CB Milestone can work with a Buyer who, in the early stages of looking for a property, prefers to select no agency representation. This situation can exist only prior to the Buyer presenting an offer on a property. When the Buyer wishes to present an offer on a specific property, he/she must make a choice regarding agency representation.
Disclosed Dual Agency: CB Milestone agents must assume this new role when they have had agency relationships with both Buyer and Seller. Buyer and Seller must agree to this in writing prior to any offer being presented. In this situation, the agent holds the confidences of each party and assists each to reach a mutually satisfactory Agreement.
